General terms and conditions of Chiemgau MTB Team e.K., owner Andreas Huber, Steinbachweg 25, 83324 Ruhpolding.

§ 1 Validity of General terms of Events

§ 2 Products of Chiemgau MTB Team e.K.

(1) Products of Chiemgau MTB Team e.K. are Event-Tickets, Chiemgau MTB Team e.K. merchandising-products and vouchers for these as well as further products of Chiemgau MTB Team e.K.

(2)The Event-Ticket is a voucher for a defined adventure. Only the owner of the ticket has the right to claim for the adventure at the specific date - defined at purchase. Please note that for the purchase of Event-Tickets only the regulations of General Terms and condition of 'Event-Tickets' are applicable.

(3) The voucher is a voucher for a defined adventure that entitles the owner to claim for the adventure at one of the adventure partner available or to claim for a defined Chiemgau MTB Team e.K. merchandising-product (by choosing size and/or colour if necessary) and to use it as means of payment for the purchase of this defined Chiemgau MTB Team e.K. merchandising-product by telephone or on this website.

§ 3 Specifications, conclusion of contract

A direct contract between you as a customer and Chiemgau King e.K. with a different performance obligation than under para. 1 is only possible with competitions organized directly by us or with the purchase of merchandising articles.

§ 4 Redemption and exchange of experience gifts and redemption of vouchers

(1) Experience gifts entitle the holder to make use of the corresponding experience with one of the available experience partners in accordance with the applicable conditions (eg for physical fitness) and the terms and conditions of the respective experience partner.

(2) Unless expressly regulated, the journey to the resort and / or any accommodation services is not included. The costs for this are to be borne by yourself.

(3) Please note that the booking of an experience with our experience partner at least two weeks before the scheduled date to claim the experience must be made. For weekends and in holiday periods we recommend a longer lead time. The binding booking of the experience takes place upon receipt of the booking confirmation by the experience partner. We therefore recommend that you make no travel and accommodation bookings, as long as you have not received a binding confirmation of the booking by the experience partner. The validity period of vouchers is two years.

(4) The experience partner is to be informed in good time about any postponements. Please note that the experience partners may charge fees in case of delays or short-term cancellations. We therefore recommend that you inform yourself in advance of the experience partner. If such fees are due, these are to be paid directly to the experience partner.

(5) If you do not appear for a booked appointment and have not canceled it in good time according to the terms and conditions of the event partner, the ticket used for claiming this experience and the resulting claim for performance shall lapse without replacement.

(6) Should Chiemgau MTB Team e.K. Merchandising products will be temporarily or permanently not available, Chiemgau MTB Team e.K. cancel the purchase contract to that extent. Please note that Chiemgau MTB Team e.K. Merchandising products can only be ordered in standard household quantities.

(7) Experience gifts and vouchers can be redeemed within the statutory limitation period of three years and the experience can be exercised until the expiry of this period (redemption period). This redemption period begins at the end of the year in which the adventure gift / voucher was purchased. Please note that discounting periods (§ 5) apply to dissolution periods which can be found in the respective document (§ 5 (2)).

§ 5 discounts, discount promotions and promotional coupons

(1) Discount campaigns allow the purchase of individual products at lower prices. Chiemgau MTB Team e.K. (4) Promotion vouchers are experience gifts that are placed on the market for advertising purposes free of charge or in connection with promotions at a greatly reduced price.

(5) Promotion vouchers can not be exchanged. However, the provisions made under §§ 15, 16 and 18 of these GTC remain unaffected.

§ 6 Prices, shipping costs, delivery restrictions

(1) The quoted price for Chiemgau MTB Team e.K. products is binding and understands each including the legal value added tax. All prices are total prices.

(2) When transferring an adventure gift or voucher, you are obliged to refer to the provisions of these terms and conditions.

(3) You are responsible for ensuring that the person making use of the respective experience fulfills the requirements (§ 11 (1)) for this. A refund of the purchase price is excluded in case of non-fulfillment of the minimum requirements.

§ 9 Legal consequences in case of loss of experience gifts and vouchers as well as purchase of experience tickets from third parties

(1) In the event of the loss or theft of experience gifts and / or product vouchers, Chiemgau MTB Team e.K. no liability for a possible improper redemption of a voucher. The provisions under § 17 (Liability of Chiemgau MTB Team e.K.) of these Terms and Conditions shall remain unaffected.

§ Liability of Chiemgau MTB Team e.K
